The Client's Situation
The tenant stopped paying monthly rent for several months. The landlord sent a certified letter terminating the lease on the ground that two or more rent payments were overdue, and the notice was properly delivered. A lawsuit combining eviction and a claim for rent was filed.
Key Legal Issue
While the case was pending, the tenant voluntarily moved out and returned possession. The eviction claim had achieved its purpose, but unpaid rent and utility charges remained. The claim had to be changed promptly, and the defense had to show that nothing would be left after deducting the deposit, so that the tenant could not rely on a defense of simultaneous performance.
