Under Article 70 of the Criminal Procedure Act, the court looks at whether the suspect has a fixed residence and whether there is a risk of destroying evidence or fleeing, while also considering the gravity of the offense and the risk of reoffending. The question was whether those grounds actually existed, despite the obvious disadvantage of a repeat offense during probation.
