Against the company's claim of personal use, the defense showed the company had not raised any issue at the time. A defense opinion was filed for the third interview.

The police closed the case without referral (no suspicion).

What This Case Shows

In embezzlement cases the issue is less that money was spent than whether the spending was allowed. Articles, internal rules and how the company handled similar spending become evidence of intent. Even late in an investigation the outcome can change, though early advice is always better.
