Circumstantial evidence showed the relationship had not been fully ended. The lawyer attended the police interview and explained points the client found hard to answer, raised the possibility that a third party had pushed for the complaint, and showed that the client had stopped contact before the complaint and would not resume it.

Result

The police found it difficult to treat the conduct as stalking and closed the case without referral (no suspicion).

Contact records almost always exist in stalking cases. The real question is under what circumstances and for what reason contact happened. Continuing to contact the other person after an interview undermines any explanation.
